Terms of Deposit

 

The following terms and conditions govern all use of the HubICL website and the services available on or at the site. The site is owned and operated by Purdue University. By electronically signing these terms and conditions and clicking the “I AGREE” button during the publication process, you agree that these Terms and Conditions apply to your use of the service and to all the data and materials (“the Work”) that you post to the site.

You grant to Purdue University a worldwide, royalty-free, non-exclusive, perpetual (for the duration of the applicable copyright) license to exercise the rights in the Work, in whole or in part, to be deposited into HubICL as stated below:

  • To use, duplicate and distribute the Work
  • To transfer the Work to any format or medium now known or later developed for archiving, preservation and access

You represent and warrant to Purdue University that the work is your original work and does not, to the best of your knowledge, infringe or violate any rights of others, nor does the deposit violate any applicable laws.

You also further represent and warrant that you have the authority and/or have obtained all necessary rights to permit Purdue University to use, duplicate and distribute the work and that any third party content is clearly identified and acknowledged within the work.

You retain the right to publish and/or share your work that is deposited to the project site in HubICL. Works that are retained in the project portion of the site can only be accessed by the project group and their designees unless otherwise stated. Works that are published in HubICL have unrestricted access for a period of time designated at HubICL’s discretion.

You acknowledge that Purdue University has the authority to grant access to the project portion of the site to third parties to study the use of the site or to improve the site.

The Work does not contain software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware or telecommunications equipment or to damage or obtain unauthorized access to any system, data, or other information in HubICL or any third party.

If human subjects were studied in the collection of the materials for the Work, you collected the materials with IRB approval.

The materials do not contain high-risk confidential information such as social security numbers, credit card numbers, medical record numbers, health plan numbers, other account numbers, certificate/license numbers or biometric identifiers (fingerprints, retina, voice print, DNA, etc.).

You acknowledge that Purdue University will not be liable for any loss of or damage to the works, either in whole or in part.

This License and the rights granted herein will terminate automatically upon any breach by HubICL of the terms of this License. Individuals or entities who have received the Works from HubICL under this License, however, will not have their licenses terminated provided such individuals or entities remain in full compliance with those licenses.

Purdue University reserves the right to release the Work under different license terms or to stop distributing the Work at any time; provided, however that any such election will not serve to withdraw this License (or any other license that has been, or is required to be, granted under the terms of this License), and this License will continue in full force and effect unless terminated as stated above.
